1.1 These terms and conditions of sale (together with our Privacy Policy, Terms of Website Use, Cookie Policy) will apply to all orders placed on our websites (www.hypothesisone.com or hypothesisone.co.uk). Please read them carefully before placing any order on our websites. By placing an order with us, you agree to be bound by these terms and the other policy documents referred to in them. If you refuse to accept these terms or any part thereof, you must not place any order with us.

3.1 All orders for delivery in the United Kingdom will remain and be fulfilled by us.
3.2 Orders for delivery addresses outside of the United Kingdom cannot be accepted and will not be fulfilled.
4.1 Each product listed on our websites is sold subject to the product’s description and price. We make every effort to ensure these details are accurate however there maybe be some discrepancies at the time you place your order.
4.2 Each product listed on our websites is also accompanied by a series product photographs, including product packaging. All photography is for illustrative purposes only. Whilst we try display these as accurately as possible, we cannot guarantee that pictures will show in the same way on your device.
5.1 We accept responsibility for statements and representations made by our authorised agents. If you have agreed any variations from these terms, please ensure these are confirmed in writing.
5.2 You must be at least 18 years old and legally capable of entering into a contract to place an order and purchase products from our website.

(ii) From the shopping bag choose Proceed to Checkout
(iii) If you an Existing Customer with a registered account you should ‘Sign into’ your online account
(iii)(a) If you are a New Customer you should ‘Press continue’, provide your contact, billing and delivery information
(iv) To complete your purchase Select Proceed to Checkout and Pay
By clicking ‘Place Order’ and ‘Checking Out’ you confirm that you have read, understood and accept these terms and conditions.
7.3 We accept the following forms of payment on our Sites: Visa, Mastercard, American Express, Diners Club, Apple Pay or Google Pay, including both debit and credit cards.
7.4 We will take full payment for your order once your order is placed on the website.
7.5 When you click ‘Place Order’, all card transactions on our Sites are processed using a secure online payment gateway that encrypts your card details.
7.6 After you have placed an order on our Sites, you will receive an email from us confirming we have received your order. This does not constitute acceptance of your order.
7.7 You will receive an email (Order Confirmation) confirming that we have accepted your order when the products have been dispatched, at this point the contract us will be formed and become binding. The contract shall be in English and will include these terms and conditions.
7.8 If we are unable to supply you with a product, for example because that product is not in stock, we will inform you by email as soon as possible and we will not process your order. If you have paid for the product(s), we will refund you the full amount paid as soon as possible.
7.9 At our discretion we can choose not to accept an order from you for any products.
8.1 Minor changes. We may revise these terms and conditions from time to time. These changes will not affect your use of the product.
8.2 More significant changes. Where we make changes to these terms or to the products and these changes affect your rights under these terms and conditions or your use of the products in any material way then we will give you written notice of any revision of these terms and conditions, and the revised terms and conditions will apply to the use of our website from the date that we give you such notice. You may then end the contract before the changes take effect by sending us an email to info@hypothesisone.com and receive a refund for any products you have paid for but have not yet received. If you do not agree to the revised terms and conditions, you must stop using our website.
9.1 We reserve the right to end the contract if you break it for any reason.
9.2 We may withdraw the product(s) at any time. We will inform you in advance and will refund any sums you have paid in advance for the product(s) which will not be provided.
10.1 We hope you are pleased with your purchase from us, but you are entitled to return any of our products within14 days from receipt of your order.
10.2 You must inform us within 14 days of receipt of your purchase if you have changed your mind or of any damage. Please let us know via email at info@hypothesisone.com.
10.3 All returns must be returned in an unused and unopened state within the timescales above. If a product is returned in an unsalable state we reserve the right to refuse a refund or to exchange the product.
10.4 As we offer free delivery on all orders, return postage is at the customer’s expense. We advise customers to send all returns via registered/tracked mail and where necessary insured. The customer is liable for any damages on returns until we receive them.
11.1 If something you have bought is faulty, broken or not as described and we agree after expecting the product, then we will give you the choice of a replacement or refund in accordance with refund policy (see paragraph 13 below). Just email us at info@hypothesisone.com and we will arrange a return, as part of this process we may request for photographs or other corroborative details of the damage.
11.2 You also have the right to terminate the contract between you and us where:
11.3 Please notify us via email or in writing if any of the circumstances detailed above apply. The contract will end as soon as we receive your notification and if you are entitled to a refund we will refund you in full for the price of any products you have paid for and which have not yet been provided.
11.4 As a consumer, you will always have statutory rights in relation to products that are faulty or not as described. These rights are not affected by our Terms and Conditions and Returns Policy.
12.1 Refunds for any reason can only be processed when the goods have returned to us and examined to confirm they are unused, unopened and suitable for resale.
12.2 You will be responsible for the cost of returning the products to us unless:
12.3 You must take reasonable care of the products while they are in your possession, returns must be sent to us unused, in their original packaging and suitable for resale.
12.4 Where you return goods to us, you we will be responsible for any loss or damage to said goods in transit. We strongly recommend you return goods by registered post or similar courier service. Always retain evidence of posting until the purchase price has been refunded.
12.5 All refunds will proceed to the same method originally used by you to pay for your purchase.
12.6 The cost of return postage to us, is the sole responsibility of the customer unless goods are deemed to be faulty.
12.7 Please note we may reduce the value of your refund to reflect any mishandling of the product(s). You have a legal obligation to take reasonable care of the product(s) while it/they is/are in your possession and are responsible for the products in transit to us. Refunds cannot be processed until the product(s) have been received by us.
12.8 We will make any refunds due to you as soon as possible and in any case, no later than 14 days after the day we receive the returned products from you.
12.9 If you change your mind and decide to return a product which was accompanied with a free sample, you must return the sample along with the product. If you have fail to return the sample we have the right to refuse a refund or make a deduction to refund amount for any missing samples.
13.1 We offer free delivery on all purchases within the United Kingdom. Timescales will vary depending on your delivery address and the courier used, we use multiple couriers to ensure we can offer free delivery for all customers. We aim, in conjunction with our courier partners, to deliver within 3-5 days of dispatch. Please read paragraph 17 about what happens if there is an event outside our control which results in a delay in delivery or failure to deliver the product. We will contact you with a revised estimated delivery date if there is an event outside our control.
13.2 We aim to send you your products by the estimated delivery date set out in the order confirmation email, or, if no date is specified, then no later than 30 days following the date of your order confirmation email. If we are unable to meet the estimated delivery date we will contact you with a revised estimated delivery date.
13.3 Delivery will be completed when we deliver the products to the address you gave us during the checkout process.
13.4 If no one is at your address to take delivery then the courier will leave a note explaining that:
(a) the delivery has been left in a secure location;
(b) the delivery has been left with a neighbour;
(c) the delivery has been returned to the courier’s depot.
In the event your delivery has been returned to the courier’s depot, please contact them to rearrange delivery. If you are experiencing any difficulties do not hesitate in contacting us at info@hypothesisine.com.
13.5 If after a failed delivery, you do not re-arrange delivery or collect the products from the delivery depot then we may charge you additional costs to cover storage and/or additional delivery charges. If despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may end the contract and we will refund you the money you have already paid for the order but reserve the right to deduct from the refund a reasonable sum as compensation for any costs we have incurred as a result.
13.6 We are responsible for the products until the point they are delivered to you. You are responsible for the products on delivery and will own the products once we have received your order payment in full.
13.7 You should check all products you receive against your order as soon as possible. If you discover that the products are damaged or mis-described after delivery, it is advisable to tell us as soon as possible as your legal rights as a consumer vary depending on the time period.
13.8 Complimentary delivery is available on all orders to the mainland UK.
13.9 We cannot offer delivery outside of the UK mainland at present, so to avoid disappointment please do not place an order if you are outside of the UK mainland as it will not be processed.
14.1 The prices of the products are quoted on our Sites. Product prices may change from time to time, but any changes will not affect any order which has been successfully placed prior to the price change.
14.2 The price of a product includes VAT at the applicable current rate (20%).
14.3 The price of a product includes delivery charges.
14.4 Our Sites contains multiple products. It is possible that, despite our reasonable efforts to ensure the accuracy of prices on our Sites, from time to time some of the products on our Sites may be incorrectly priced. If we discover an error in the price of the products you have ordered, we will inform you of this error and we will give you the option to proceed with the order at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you then we will treat the order as cancelled and notify by email. If the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing, we do not have to provide the products to you at the incorrect price.
15.1 We may offer special promotions (such as discounts or offers) on certain products from time to time. We have the right to withdraw any promotions at any time and they may also be subject to time restrictions, availability and other terms and conditions.
15.2 To avoid disappointment, please ensure you check the terms for a promotional offer before trying to redeem it.
15.3 We may occasionally offer promotional discounts, with or without a promotion code. Promotions with codes are usually only valid for one transaction and once used the code will be deactivated.
15.4 Promotions must be added to an order before the order has been confirmed and cannot be added retrospectively. To avoid disappointment please check any voucher is applied before you confirm and pay for your order.
15.5 hypothesis one reserves the right to withdraw, delay, interrupt, or postpone any promotion or to modify all or part of the modalities of the present rules without incurring any liability.
16.1 If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a natural, foreseeable consequence of our breach of these terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of our breach or if they were contemplated by you and us at the time we entered into the contract.
16.2 We only supply the products to you for domestic and private use. You agree not to use the product for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
16.3 We do not in any way exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation or for any breach of any terms implied by law including your right to receive products as described and match information we provided to you and any sample or model seen or examined by you; of satisfactory quality; fit for any particular purpose made known to us; supplied with reasonable skill and care and, where installed by us, correctly installed.
17.1 We may have to suspend performance of the contract between us and you if we are unable to perform our obligations due to any circumstances outside our reasonable control which includes:
17.2 We will contact you in advance to tell you we will be suspending supply of the product. If we have to suspend delivery of the product for longer than 30 days beyond the estimated delivery date then unless you agree to the revised date you may contact us to end the contract and we will refund any sums you have paid in advance for the product. Where we do we will have no further liability to you.
18.1 Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you are not happy with how we have handled any complaint, you may want to use alternative dispute resolution. This does not prevent you going to court if you are still not satisfied with the outcome.
